Terms of use and legal notice
These terms govern access to and use of www.audienceseems.com and the purchase of Audience Seems plans. By creating an account or buying a plan you accept this document, so it is worth reading first.
1. Who provides the service
- Provider: BLACK FLAG DESIGN STRATEGY, S.L.
- Spanish tax ID: B72514565
- Registered address: Calle Gaztambide 16, 1A, 28015 Madrid, Spain
- Contact email: hola@blackflag.es
- Website: www.audienceseems.com
Hereafter, "we". Whoever uses the service, "you". Audience Seems is a trading name of BLACK FLAG DESIGN STRATEGY, S.L..
2. What Audience Seems is, and what it is not
Audience Seems simulates focus groups with synthetic participants generated by artificial intelligence models. You send a stimulus — a question, a claim, a price, a concept — and get reactions from several consumer archetypes, with a report and exports.
The participants are not real people and their answers are not field data. They are archetypes built from segment descriptions and the output of a language model. They work as an early directional signal — to rule things out fast, sharpen a message or prepare later research — and do not replace market research with human participants, nor do they constitute professional advice of any kind. Do not present their answers as the results of a study with real people: besides being untrue, it may amount to misleading advertising towards your own clients.
3. Who can buy
The service is aimed at professionals, companies and agencies. To sign up you must be over 18 and have legal capacity to contract. If you buy on behalf of a company, you declare that you have authority to bind it.
4. Account and credentials
- The details you give when signing up must be truthful and up to date.
- You are responsible for keeping your password safe and for everything done from your account. Tell us as soon as you suspect unauthorised access.
- An account belongs to one holder. It cannot be resold, assigned, or its access shared with third parties outside your organisation.
5. Plans and prices
The current plans and what they include are published on the pricing page:
- Demo — €0. One question every 48 hours, with no accumulation, using the preset audiences. The limit applies per account and per IP address.
- Focus Sprint — €7.99. A one-off purchase, not a subscription. It grants 10 questions — 60 synthetic responses with the panel of 6 — which expire 30 days after purchase. Buying another Sprint adds 10 questions to whatever you have left unused and restarts the window at 30 days from that new purchase. Once spent or expired, your account keeps its history and reports, and usage reverts to the Demo plan.
- Studio Pro — €59.99/month. An automatically renewing monthly subscription, with up to 10 focus groups and 100 questions a month (600 synthetic responses with the panel of 6). On cancellation you keep access to your history and downloads; usage reverts to the Demo plan.
All prices are shown with VAT included where it applies. The invoice breaks down the taxable base and the tax charged. We may change prices at any time; the change does not affect what has already been paid and, for subscriptions, you will be told before the next renewal, with the option to cancel at no cost.
6. Payment, renewal and cancellation
Payments are processed through Stripe. We never store your card details: the payment provider handles them directly.
- Focus Sprint is charged once and does not renew.
- Studio Pro renews automatically every month until you cancel. You can cancel whenever you like from the billing portal in your account; the plan stays active until the end of the period already paid for and the next one is not charged. Periods already started are not pro-rated.
- If a charge is declined, we may suspend access to the paid features until it is settled.
7. Right of withdrawal
If you buy as a consumer — outside your professional activity — you have 14 calendar days to withdraw from the contract without giving a reason, by telling us at hola@blackflag.es.
That said, the service consists of the immediate supply of digital content generated at your request. By running your first session on a paid plan you expressly request that performance begin immediately and acknowledge that, once fully performed, you lose the right of withdrawal in respect of that supply (article 103, points a) and m), of the Spanish consolidated text of the General Law for the Defence of Consumers and Users). If you have not started a session, we refund the full amount within the period.
If you buy as a company or professional, this right does not apply.
8. Acceptable use
When using Audience Seems you undertake not to:
- Enter third parties' personal data into stimuli, transcripts or brand names without a legal basis for doing so. The service is not designed to process personal data inside session content.
- Enter special categories of data (health, political opinions, religion, sexual orientation, ethnic origin) or third parties' confidential information.
- Use the service to generate unlawful, defamatory, discriminatory or misleading content, or content that infringes third-party rights.
- Present the results as research carried out with real people (see section 2).
- Automate access, resell capacity, circumvent your plan's usage limits, reverse-engineer the platform or attempt to extract the prompts and models behind it.
- Compromise the security or availability of the service, or other users' access to it.
Breaching this section allows us to suspend or cancel the account, with no refund of the unused portion where the breach is serious.
9. Your content and intellectual property
- What you bring is yours. The stimuli, brands, materials and descriptions you enter remain their owner's. You grant us only the licence needed to provide the service: to process them, send them to the language models that generate the answers, and store them in your account.
- The results of your sessions are yours. Transcripts, reports and exports can be used freely in your work, within the limits of section 2.
- The platform is ours. The software, the brand, the design, the architecture of the archetypes and the prompts behind them belong to BLACK FLAG DESIGN STRATEGY, S.L. or its licensors. Buying a plan grants the right to use the service, not rights over its code or its content.
- Content generated by AI models may be neither original nor protectable by copyright. Check that any expression is available before using it commercially.
10. Learning across sessions
Participants accumulate two kinds of memory. What they think about a specific brand is tied to your account and shared with no other: nobody can work out which brands you have tested or what was said about them. What the participant learns about themselves — how much they will pay, which arguments tire them — is kept in aggregate with no reference to any brand, because that is what makes the archetype evolve. This second kind is stripped of any brand name before it is stored.
11. Availability
We work to keep the service continuously available, but we do not guarantee uninterrupted availability: we depend on third-party hosting and AI model providers. We may carry out maintenance, evolve features or withdraw them, giving reasonable notice when the change matters for a paid plan.
12. Warranties and liability
The service is provided "as is". We do not warrant that the synthetic participants' answers are accurate, complete, representative of a real population or fit for any particular purpose. The business decisions you make from them are yours.
Except for wilful misconduct or gross negligence, and except for damages the law does not allow to be excluded — among them personal injury and consumers' statutory rights — our total liability towards you is limited to the amount you have paid us in the twelve months before the event giving rise to it. We are not liable for loss of profit or indirect damages.
13. Data protection
The processing of personal data is described in the privacy policy and the use of cookies in the cookie policy, both of which form part of these terms.
14. Term and termination
You can stop using the service and delete your account whenever you like. We may suspend or cancel it if you breach these terms, if it is necessary for legal or security reasons, or if we stop providing the service, in which case we will give reasonable notice and refund the unused proportion of what you paid.
15. Changes to these terms
We may update them to reflect legal or service changes. If the change is material and you are on a paid plan, we will tell you by email at least 15 days in advance; if you disagree, you can cancel before it takes effect. The applicable version is the one published at the time of each purchase.
16. Governing law and disputes
These terms are governed by Spanish law. If you act as a consumer, the courts of your domicile have jurisdiction and you keep every right consumer law grants you. In all other cases, the parties submit to the courts of the city of Madrid.
If you are a consumer, you can use the European Commission's online dispute resolution platform: ec.europa.eu/consumers/odr. Before that, write to us: most things get sorted out by email.
